Terms of sale

Last updated 27 October 2026

These terms govern every photographic commission booked with Vision. They apply to private clients and, unless agreed otherwise in writing, to business clients.

Registration in progress. Fields shown in [this style] are completed as soon as the registration number is issued. Any amount, rate or deadline not fixed here is fixed by the accepted quote, which governs each individual order.

This is a translation. The French version of these terms is the binding one. This English page is provided for information only.

1. Purpose and acceptance

These terms of sale set out the rights and obligations of both parties for a photography commission carried out by Vision, whatever the booking channel: this site, an email exchange, a quote, or an order placed by word of mouth.

Any order implies full acceptance of these terms in the version in force on the date of the quote. The client confirms they have read them before ordering. A conflicting condition proposed by the client is only enforceable after written agreement from the photographer.

2. The provider

3. Services covered

Vision carries out photography assignments and sessions:

Additional retouching, prints, albums, printed objects and any commercial licence for the images may be added on quotation.

4. Quote and formation of the contract

Every project starts with a free, no-obligation written quote, prepared after a discussion about the date, the place, the duration and the intended use of the photographs.

The quote states: the service and what it includes, the indicative number of photographs delivered, the delivery deadline, the total price, the deposit required, any travel costs, and how long the offer remains valid.

The contract is formed when the client returns the signed quote, or accepts it in writing (email included), and pays the deposit requested. The date is only booked once that payment is received; no slot is held before then.

5. Price

Prices are in euros, inclusive of tax. They cover the shoot, the selection, the retouching included in the quote, and delivery of the digital files.

Not included, unless expressly stated in the quote: travel and accommodation beyond the area named in the quote, entrance or filming fees charged by a venue, hire of specific equipment, prints and albums, and commercial usage licences.

The price in the accepted quote is fixed. Only additional work requested during the assignment, or a change of date or place requested by the client, can give rise to a supplement, agreed in writing in advance.

6. Payment

Late payment carries, after a formal notice that has remained without effect for eight days, interest at the statutory rate in force and, for business clients, the fixed recovery indemnity of €40 provided by article D.441-5 of the French commercial code. Files may be withheld until payment is complete, without depriving the client of the photographs once the price is paid.

7. Right of withdrawal

Principle

Where the contract is concluded at a distance (site, email, telephone) with a consumer client, that client has fourteen days from its conclusion to withdraw, without giving a reason and without penalty, under articles L.221-18 and following of the French consumer code.

Exception for services on a specific date

Under article L.221-28, 3° of the French consumer code, the right of withdrawal cannot be exercised for leisure services supplied on a specific date or at a specific frequency. A session or assignment booked for a fixed date falls into that category: the date is reserved for that client and cannot be resold.

Request to begin before the deadline

If the client expressly asks for the service to begin before the fourteen days have elapsed, they may still withdraw; they must then pay for the work already carried out, in proportion to what was supplied (article L.221-25).

How to withdraw

Through the contact form, or using the standard form reproduced in the annex. An acknowledgement is sent without delay. The refund is made within fourteen days of receiving the withdrawal, using the same payment method as the order.

8. Organisation and running of the assignment

9. Delivery of the photographs

Photographs are delivered through a private online gallery, reached by a personal link, as high-resolution JPEG files in the sRGB colour space, without a watermark.

10. Retention and backup

The photographer keeps a copy of the delivered files for the period stated in the quote, as a courtesy and not as a guarantee of preservation. After that period the files may be deleted without notice.

The client is advised to keep their photographs on at least two separate media, including one copy away from home. Loss of a file by the client cannot be attributed to the photographer.

11. Cancellation, postponement and inability to attend

By the client

Any cancellation is notified in writing. The applicable conditions and scale appear in the accepted quote; failing that, the deposit is retained as compensation for the reserved slot, unless the cancellation occurs more than thirty days before the planned date, in which case it is returned.

A postponement is possible if another date is available. A first postponement requested more than thirty days before the assignment is free of charge; later postponements may incur an administrative fee stated in the quote.

By the photographer

In the event of illness, accident or serious inability to attend, the photographer informs the client as soon as they know and offers, with the client’s agreement, either a replacement by a trusted photographer, a new date, or a full refund of the sums paid. No further compensation is due beyond that refund.

12. Force majeure

Neither party is liable for failure to perform an obligation caused by a force majeure event within the meaning of article 1218 of the French civil code: an event that is unforeseeable, irresistible and external (natural disaster, administrative decision, epidemic, closure of a venue, general strike). Sums paid are then returned, less the work already carried out.

Photographs are protected works. The photographer retains authorship and all moral rights, including after delivery and after full payment.

For the photographs delivered, and after full payment, the client receives a private usage right: reproduction, printing, sharing with family and friends, and publication on their personal accounts, without commercial purpose, for an unlimited period and worldwide.

In accordance with article L.131-3 of the French intellectual property code, each right granted is expressly identified: the right of reproduction and the right of representation of the delivered images, on paper and in digital form, to the exclusion of any other right.

The following remain reserved to the photographer, unless separately quoted:

The client undertakes not to resell, transfer or distribute the files for commercial purposes, and not to pass them to a third party who would exploit them. Where the photographer publishes an image, the photo credit is reserved to them.

14. Image rights and publication

Delivery of the photographs does not constitute permission to publish them on this site or on the photographer’s social accounts. Any publication requires the separate written agreement of the person shown, collected with the Image publication consent form.

That agreement can be withdrawn at any time, without justification; the photograph is then removed without delay.

Where the client commissions an assignment in which other people appear (guests, teams, audience), it is for the client to inform them and to ensure they do not object to being photographed. The photographer publishes an image of an identifiable third party only with that person’s agreement, or that of their legal representative if they are a minor.

15. Personal data

Data provided to prepare a quote, carry out the assignment and issue invoices is processed in accordance with the privacy policy, which sets out the purposes, recipients, retention periods and the rights of the people concerned.

16. Legal guarantees

Prints, albums and other goods supplied benefit from the legal guarantee of conformity (articles L.217-3 and following of the French consumer code) for two years from delivery, and from the guarantee against latent defects (articles 1641 and following of the French civil code).

These guarantees cover manufacturing and conformity defects, not normal wear, an accident, poor storage or modification by the client. For business clients, the guarantee against latent defects applies under the conditions of the French civil code.

17. Liability

The photographer is bound by an obligation of means: they apply the skill and equipment required, without being able to guarantee a particular artistic result, or the exact reproduction of an image already published.

If files are lost or destroyed before delivery, the photographer’s liability is limited to the total amount paid for the assignment concerned, except in the case of gross negligence or wilful misconduct. That limitation does not apply to personal injury or to mandatory statutory obligations.

The photographer is not liable for damage caused by a third party, by a venue, by the people present, or by the client’s failure to follow the instructions given.

18. Complaints and mediation

Any complaint is sent in writing through the contact form. A reply is given within fifteen days.

Under article L.612-1 of the French consumer code, a consumer client may use a consumer mediator free of charge where a dispute has not been settled by a prior written complaint addressed to the photographer. The competent mediator is [CONSUMER MEDIATOR], [MEDIATOR ADDRESS AND WEBSITE]. Mediation is free for the client and suspends the limitation periods while it runs.

19. Non-performance and termination

If a party seriously breaches its obligations, the other party may, after a formal notice that has remained without effect for fifteen days, terminate the contract in writing. Work already carried out remains payable and sums paid are retained in proportion.

A consumer client may also terminate the contract under articles L.221-10 and following of the French consumer code where the service is not supplied on the agreed date.

20. Governing law and jurisdiction

These terms are governed by French law. They are drafted in French; this English version is provided for information and has no contractual value in the event of a discrepancy.

In the event of a dispute, an amicable solution is sought first. Failing that, a consumer client may bring the matter before the court of their domicile or the court of the place where the service was performed; the photographer acts before the competent court under the rules of the French code of civil procedure. No clause deprives the consumer of the protective rules of their country of residence where those rules are mandatory.

21. Entry into force and updates

These terms apply to orders placed after they are published online. Any change is published on this page, with the update date. Orders already in progress remain governed by the version accepted at the time of the quote.
